What is a Mass Tort?
A civil action perpetuated by one individual or person which causes harm to another is called a tort. Legally, corporations are considered to be a “person.”
A mass tort involves numerous victims who sue one defendant or multiple defendants. All individual plaintiffs need to sue as a result of damages and/or injuries originating from a common product.
A mass tort action is created when the lawyers for a group of plaintiffs request the court for permission to file. The court then reviews the following criteria as well as various other issues prior to giving permission:
- The amount of plaintiffs involved;
- Where plaintiffs are located;
- If injuries are similar in nature and suffered by plaintiffs
- If claims of plaintiffs have a commonality, i.e. an individual product or incident.
Mass tort actions handle each plaintiff as an individual. Each Plaintiff will have their own individual trial.
